商標註冊

 

 

優點

一個成功的商標可提高商標持有人的商譽。這不但能帶來此豐厚的利潤，亦可為商標持有人推廣業務。為了保護知識產權上的權益，商標持有人應替自己的商標進行註冊。商標申請一旦獲得批准，申請人便擁有商標的獨家使用權。此外，當商標權益受到侵權時，申請人可採取法律行動，禁制侵權行為及追討賠償。因此，最佳保障的方法，便是替自己的商標進行登記。

 

申請程序

  • 註冊前查冊

商標註冊原則上是以＜先到先得＞的形式進行。若你所申請的商標與其他已註冊的商標中所含的文字或圖象相似，你的申請將不容昜被接納。有見及此，第一步就以註冊商標樣本5個(9cm X 9cm) 申報到知識產權處查冊。約3星期後，註冊處回覆初步意見或修訂註冊細則，確定商標式樣後，即正式開始申請。

 

  • 申請商標

在遞交商標註冊申請後2-3個月，商標註冊處將完成商標審查報告，列出該商標能否成功註冊及註冊的相關限制項目。

 

  • 刑登公報

批核後商標須刊登在香港政府公報上，公眾在公報出刊後３個月內可提出理據對該商標的註冊申請提出反對議案，若沒有人提出反對，此註冊便算成功。政府知識產權署會正式發出註冊商標証書。

 

備註

  • 首期須在查冊前支付，任何情況下不獲退款。

  • 首期包括兩次免費查冊費，由第三次查冊起，將收取查冊費每次$600

  • 商標費用均只包括一項〝商標類別〞

  • 如以多項商標類別申請者，需附加政府登記費$650 (以每項〝商標類別〞計算)

  • 註冊商標可享10年期限，期滿後可再續10年

 

備註

 

  • 自2003年4月1日後申請之註冊商標，可享10年期限，期滿後需再續期10年

  • 必須於商標屆滿日前6個月內申請續期，逾期者罰款$500

  • 逾期達６個月以上續牌者，將需繳府\付恢復商標註冊費$4000，否則需重新申請商標

Application Procedures 

Search before registration 

Based on the principles of trademark registration <first-come> the form. After the submission of applications for trademark registration for 2-3 months, the Trade Marks Registry will complete the trademark examination report that lists the success of the trademark registration and related restricted items. 

 

Punishment bulletin board 

After the approval of the trademark shall be published in the Government Gazette, the public may be made after the bulletin's issue within three months of the application for a registered trademark of the justifications put forward to oppose the motion, if there is no objection, the registration will be considered a success. Intellectual Property Department will be formally issued trademark registration certificates. 

 

Remarks 

The first phase should be paid before the search, no refund under any circumstances. 

The first phase includes two free search fees, starting from the third search, search fees will be charged for each $ 600 

Trademark costs are only included a "trademark category" 

In a number of categories such as trademark applicants who need additional government registration fee of $ 650 (for each "trademark category" computing) 

Registered trademarks enjoy 10-year period after the expiration of 10 years may be adjourned 

 

Remarks
